1. Who we are

Octopus Baits is a partnership between Christopher Root and Jonathan Root.

We are not currently registered for VAT, so no VAT is charged on your order.

In these terms, "we", "us" and "our" mean Octopus Baits. "You" means the person placing the order.

2. These terms

These terms apply to every order placed through octopusbaits.co.uk. Please read them before you order. We may change them from time to time; the version that applies to your order is the one published when you placed it.

Nothing in these terms affects your statutory rights as a consumer.

3. Placing an order

Your order is an offer to buy from us. A contract is formed only when we send you an email confirming that your order has been dispatched.

We may refuse or cancel an order where the goods are unavailable, where there has been an obvious pricing or description error, or where we suspect fraud. If we cancel after you have paid, we will refund you in full.

4. Products

We describe our products as accurately as we can. Images are illustrative — bait is made in small batches and there may be minor variation in colour, size and finish between batches. This is normal and not a fault.

Our products are fishing bait, intended solely for use as bait for coarse fishing. They are not for human consumption. Keep out of reach of children and pets.

You are responsible for using our products lawfully and in line with the rules of any fishery or water you fish. We are not responsible for losses arising from misuse.

5. Storage of bait

All of our bait must be stored out of direct sunlight, in a cool, dry place, away from moisture. This applies to sealed products and, in particular, to any product once it has been opened. Once opened, reseal the packaging as fully as you can and keep it dry.

Bait stored in heat, sunlight or damp conditions after delivery can sweat, soften, go mouldy or lose its attraction profile. Damage arising from storage conditions after the goods have been delivered to you is not a manufacturing fault. Please see our Returns and Refunds policy for how this affects returns.

6. Price and payment

Prices are shown in pounds sterling and are correct at the time of publication. Delivery charges are added at checkout and shown before you pay.

If we discover an obvious pricing error after you order, we will contact you before dispatch and you may confirm the order at the correct price or cancel it for a full refund.

We accept the payment methods shown at checkout. Payment is taken at the point of order.

7. Delivery

We deliver to mainland UK addresses only. Orders are dispatched within 3 working days and typically arrive 2 to 5 working days after ordering. Full details are in our Delivery policy.

Goods are your responsibility once they are delivered to the address you gave us. Ownership passes to you when we receive payment in full.

8. Cancellation, returns and refunds

If you are a consumer, you have a legal right to cancel your order within 14 days of receiving the goods, and separate rights if goods are faulty, not as described or not fit for purpose. Refunds are made in money, to your original payment method.

9. Your personal data

We handle your personal data in line with our Privacy Policy.

10. Use of this website

The content of this site, including text, images, branding and product descriptions, belongs to us and may not be copied or reproduced commercially without our written permission.

We take reasonable care to keep the site available and accurate, but we do not guarantee it will be uninterrupted or error-free.

11. Our liability

If we fail to comply with these terms, we are responsible for loss or damage you suffer that is a foreseeable result of our breach. We are not responsible for losses that were not foreseeable.

We do not exclude or limit our liability in any way where it would be unlawful to do so. This includes liability for death or personal injury caused by our negligence, for fraud, or for any breach of your statutory rights as a consumer.

Where you buy from us for business purposes, our total liability is limited to the price of the goods, and we are not liable for loss of profit, loss of business or any indirect or consequential loss.

12. Events outside our control

We are not liable for delays or failures caused by events outside our reasonable control. If such an event occurs we will contact you as soon as possible, and you may cancel and receive a refund for goods not delivered.

13. Complaints

If something has gone wrong, email octopusbaits@gmail.com and we will do our best to put it right. If we cannot resolve it, you may be able to use an alternative dispute resolution scheme, or take the matter to court.

14. Governing law

These terms are governed by the law of England and Wales. You may bring proceedings in the courts of England and Wales, or in the courts of Scotland or Northern Ireland if you live there.
